What if we don't settle?
This is rare, though if it does happen the parties might want to try another day of mediation, continue negotiations on their own, or they might go back to the litigation. In those few cases that don't settle on the day very often a settlement is reached within a few days or weeks of the mediation as a direct result of the parties' experience during the mediation.
